Seguridad jurídica del compareciente que no puede firmar en documentos notariales

Abstract

La presente tesis fundamenta la necesidad de aplicar simultáneamente la Ley del Notariado Plurinacional y el Código Civil, ambos de rango legal, para garantizar la seguridad jurídica de los comparecientes que no pueden firmar documentos notariales. Esta propuesta se sustenta en el principio de protección de derechos, asegurando que todas las personas, sin importar sus limitaciones, tengan acceso equitativo a la justicia y a la formalización de actos jurídicos.This thesis establishes the necessity of simultaneously applying the Plurinational Notary Law and the Civil Code, both of legal rank, to guarantee the legal certainty of appearing parties who cannot sign notarial documents. This proposal is based on the principle of protection of rights, ensuring that all people, regardless of their limitations, have equitable access to justice and the formalization of legal acts.
