This research analyzes the economic and legal impact of the current regulatory framework governing the disposal of confiscated goods in the Plurinational State of Bolivia, focusing specifically on vehicles seized due to smuggling offenses or declared abandoned. In 2024, the National Customs Service reported the seizure of 2,498 vehicles—an average of 208 units per month—with an estimated seizure value of Bs. 386,000,000.00. The core issue stems from the fact that Laws No. 615 and No. 975 mandate an administrative process for the free, socially-oriented allocation of these vehicles to the Ministry of the Presidency; this process is further complicated by the suspensive effect of legal challenges and delays in vehicle appraisals by DIPROVE. This dynamic results in a procedural backlog involving 12 to 24 months of forced immobilization within customs facilities, causing accelerated technical asset depreciation of up to 25% annually and significantly undermining the recovery of funds for the public treasury.
