Manual de recolección de datos en trámites voluntarios notariales en materia sucesoria, a fin de garantizar el principio de seguridad jurídica

Abstract

Con la promulgación de la Ley No 483, se reconoce un nuevo rol al notario de fe pública, facultado para tramitar la vía voluntaria notarial en tres materias: civil, familiar y sucesoria, siendo este último objeto de la presente investigación, otorgando la norma la responsabilidad de garantizar el derecho de los concurrentes y el derecho de oposición del tercero interesado, sin embargo, es la misma norma que no establece mecanismos para que el notario pueda cumplir con este rol.

With the enactment of Law No. 483, a new role is recognized for the notary public, empowered to process voluntary notarial proceedings in three matters: civil, family and inheritance, the latter being the subject of this research, giving the rule the responsibility to ensure the right of the concurrent and the right of opposition of the interested third party, however, it is the same rule that does not establish mechanisms for the notary to fulfill this role.
