El principio de prudencia en la Ley N° 483 del Notariado Plurinacional

Abstract

El servicio notarial como institución además de ser creada por una norma se mantiene por la confianza de la sociedad, no obstante, actualmente este se rige por un legalismo, siendo necesario trascender a corrientes filosóficas acordes un derecho notarial justo, acorde a la resolución de las necesidades de los usuarios, permitiendo que el notario, al margen de cumplir la norma, actúe bajo el principio de prudencia, con el propósito de alcanzar un documento notarial justo.

The notarial service, as an institution, is sustained not only by law but also by society’s trust. However, it is currently governed by a legalistic approach, making it necessary to move toward philosophical currents consistent with a just notarial law, oriented toward resolving users’ needs. This would allow notaries, beyond merely complying with the law, to act under the principle of prudence in order to achieve a fair notarial instrument.
