Vacío legal en los requisitos del trámite voluntario de divorcio notarial

Abstract

After making a diagnosis of the legal bases on which Law N°483 is based, it can be noticed the existence of a legal vacuum in the process of Notarial Divorce, by not considering the possibility of the existence of a possible descendant (conceived) product of the spouses, who could ignore even the pregnancy or state of gestation of the woman, violating the rights of the possible conceived.

Después de realizar un diagnóstico de las bases jurídicas en las cuales se sustenta la Ley N°483 se puede advertir la existencia de un vacío legal en el trámite de Divorcio Notarial, al no considerar la posibilidad de la existencia de un posible descendiente (concebido) producto de los cónyuges, quienes podrían desconocer incluso el embarazo o estado de gestación de la mujer, vulnerando derechos del posible concebido.
