Institucionalización del habeas corpus preventivo como garantía jurisdiccional para evitar violaciones del debido proceso

Abstract

La investigación se realizó teniendo como tema: "INSTITUCIONALIZACIÓN DEL HABEAS CORPUS PREVENTIVO COMO GARANTÍA JURISDICCIONAL PARA EVITAR VIOLACIONES DEL DEBIDO PROCESO". Dentro del marco jurídico de la legislación ecuatoriana, el recurso de Habeas Corpus es un mecanismo legal que permite a una persona que se considere ilegal, arbitraria e ilegítimamente detenida, ejercer la acción correspondiente para recuperar su libertad.The research was conducted with the theme: "INSTITUTIONALIZATION OF PREVENTIVE HABEAS CORPUS AS A JURISDICTIONAL GUARANTEE TO AVOID VIOLATIONS OF DUE PROCESS". Within the legal framework of Ecuadorian legislation, the Habeas Corpus remedy is a legal mechanism that allows a person who considers themselves illegally, arbitrarily and illegitimately detained to exercise the corresponding action to regain their freedom.
