Eficacia de la implementación de la vía voluntaria notarial civil en la descongestión del sistema judicial boliviano

Abstract

La presente investigación se centra en evaluar la eficacia de la implementación de la vía voluntaria notarial civil como instrumento en la descongestión del sistema judicial boliviano a partir de la puesta en vigencia de la Ley 483 del Notariado Plurinacional, dado que esta normativa reconoce por primera vez a la vía voluntaria notarial cuya finalidad prima facie es descongestionar la vía judicial. Los notarios a partir de la puesta en vigencia de esta Ley pueden sustanciar tramites en la vía voluntaria notarial con el fin de evitar la sobrecarga procesal que se genera en los juzgados, sin que esto signifique limitar la competencia asignada a las autoridades judiciales.

This research focuses on evaluating the effectiveness of the implementation of the voluntary civil notarial procedure as an instrument to decongest the Bolivian judicial system since the entry into force of Law 483 of the Plurinational Notary Public, since this regulation recognizes for the first time the voluntary notarial procedure whose purpose is prima facie to decongest the judicial system. The notaries as of the enactment of this Law can substantiate procedures in the voluntary notarial route in order to avoid the procedural overload that is generated in the courts, without this meaning to limit the competence assigned to the judicial authorities.
