Un nuevo modelo de divorcio o desvinculación notarial en Bolivia

Abstract

La presente investigación tiene como principal objetivo proponer un nuevo modelo de procedimiento notarial de divorcio o desvinculación notarial por mutuo acuerdo, para lograr el descongestionamiento del sistema judicial de familia en Bolivia. Se parte de que aún regulado normativamente el divorcio notarial en Bolivia, con un propósito desjudicializador del divorcio y la desvinculación, este fin no se ha conseguido. Se precisa entonces, perfeccionar el modelo jurídico para lograr los objetivos descongestionadores del sistema judicial de familia que se pretenden.The main objective of this research is to propose a new model of notarial divorce procedure or notarial separation by mutual consent, in order to decongest the family judicial system in Bolivia. It is based on the fact that even though notarial divorce is regulated in Bolivia, with the purpose of de-judicializing divorce and separation, this end has not been achieved. It is therefore necessary to improve the legal model in order to achieve the desired objectives of decongesting the family judicial system.
