Resumen/Abstract
El presente trabajo investigación de tesis, se ha generado a partir del análisis que efectúa el Ministerio de Gobierno a través de su Dirección General de Asuntos Jurídicos, respecto a los recursos jerárquicos, que se originan de los procedimientos administrativos sancionatorios que inicia la Dirección General de Migración contra ciudadanos extranjeros y personas jurídicas que tienen relación con el movimiento migratorio. En el entendido de que, este ente jerárquico aglutina en su estructura a diversos Viceministerios (Viceministerio de Régimen Interior y Policía, Viceministerio de Defensa Social y Sustancias Controladas y Viceministerio de Seguridad Ciudadana) y Direcciones (Dirección General de Migración, Dirección General de Régimen Penitenciario, Dirección General de Registro, Control y Administración de Bienes Incautados y Dirección General de Recaudaciones); evidenciándose que, no ostenta una especialidad en materia de sanciones migratorias, siendo indispensable dicho aspecto a momento de resolver los recursos jerárquicos, puesto que la medida de expulsión afecta derechos humanos de los migrantes, los cuales se encuentran desarrollados y protegidos por esferas internacionales, debiendo por tanto, cumplirse con el debido proceso en su vertiente de debida fundamentación, que así lo exige la Constitución Política del Estado, normativa migratoria y jurisprudencia emanada por el Tribunal Constitucional Plurinacional. Situación similar que ocurre en el caso de personas jurídicas, toda vez que al afectar su patrimonio con las multas impuestas por sanciones migratorias, es imperante cumplir con dicho principio.
This thesis research work has been generated from the analysis carried out by the Ministry of Government through its General Directorate of Legal Affairs, regarding the hierarchical resources, which originate from the administrative sanctioning procedures initiated by the General Directorate of Migration against foreign citizens and legal entities that have a relationship with the migratory movement. With the understanding that, this hierarchical entity brings together in its structure various Vice-Ministries (Vice-Ministry of Internal Regime and Police, Vice-Ministry of Social Defense and Controlled Substances and Vice-Ministry of Citizen Security) and Directorates (General Directorate of Migration, General Directorate of Penitentiary Regime , General Directorate of Registration, Control and Administration of Seized Assets and General Directorate of Collections); It is evident that it does not have a specialty in matters of immigration sanctions, this aspect being essential when resolving hierarchical appeals, since the expulsion measure affects the human rights of migrants, which are developed and protected by international spheres, and must Therefore, due process must be complied with in its aspect of due foundation, which is required by the Political Constitution of the State, immigration regulations and jurisprudence issued by the Plurinational Constitutional Court. A similar situation occurs in the case of legal entities, since by affecting their assets with the fines imposed by immigration sanctions, it is imperative to comply with said principle.
