Límites constitucionales al ejercicio del notariado en Bolivia

Abstract

El presente trabajo, tiene por finalidad, describir los límites constitucionales al ejercicio del Notariado Plurinacional en el Estado boliviano, asumiendo a priori, que dicha función se cumple únicamente en sujeción a la normativa legal, es decir sin considerar principios, valores y derechos fundamentales establecidos en la Norma Suprema, por otro lado también se analizará, de manera inductiva, el ejercicio del notariado en el contexto internacional, comparado y nacional, de ese modo, establecer, con apoyo de un trabajo de campo, la hipótesis antes planteada, es decir que el ejercicio del Notariado Plurinacional, muchas veces no se lo asume en cumplimiento de los principios de supremacía constitucional y jerarquía normativa.

The purpose of this work is to describe the constitutional limits to the exercise of the Plurinational Notariat in the Bolivian State, assuming a priori that this function is carried out solely in accordance with legal regulations, that is, without considering the principles, values and fundamental rights established in the Supreme Norm. On the other hand, the exercise of notarial practice will also be analyzed inductively in the international, comparative and national context, in order to establish, with the support of field work, the hypothesis previously stated, namely that the exercise of the Plurinational Notariat is often not carried out in compliance with the principles of constitutional supremacy and normative hierarchy.
