Resumen/Abstract
La usucapión es un instituto que se remonta a la época del derecho romano y es a partir de este instituto que una persona adquiere un derecho real de propiedad, mientras otra la pierde por su descuido en la posesión de sus bienes al abandonarlos. La usucapión nace como un mecanismo de prueba definitiva de la propiedad que busca reconocer como propietario a la persona que se ha comportado como verdadero dueño de un bien, con base en la posesión prolongada del mismo y con las características establecidas en la ley. Una acción judicial de usucapión puede tardar años, la usucapión extrajudicial, mediante un procedimiento notarial, será capaz de abreviar ese tiempo para apenas unas semanas, posibilitando así la realización práctica del derecho de propiedad, con importantes repercusiones jurídicas, sociales y económicas.
The usucapion is an institute that dates back to the Roman law era and it is from this institute that a person acquires a real right of ownership, while another person loses it due to his carelessness in the possession of his goods by abandoning them. The usucapion was born as a mechanism of definitive proof of ownership that seeks to recognize as owner the person who has behaved as the true owner of a property, based on the prolonged possession of the same and with the characteristics established by law. A judicial usucaption action can take years, the extrajudicial usucaption, through a notarial procedure, will be able to shorten that time to just a few weeks, thus enabling the practical realization of the right of ownership, with important legal, social and economic repercussions.
