La aceptación de herencia a favor de menores de edad como trámite en la vía voluntaria notarial

Abstract

La nueva legislación notarial, junto a la reforma total del sistema procesalista en materia civil, implementa la desjudicialización de algunos procesos voluntarios, entre ellos, la aceptación o renuncia a la herencia, confiando su tramitación en la sede notarial. Institución jurídica sucesoria que se complementa con la novel disposición del Código de las Familias y el Proceso Familiar, respecto a la autoridad paterna/materna sobre los bienes propios de los menores de edad; limitada y supervisada en su ejercicio por el propio Estado. Todas estas nuevas previsiones, han impuesto en la práctica el siguiente cuestionamiento: Si el Código de las Familias en su artículo 51 prevé que la aceptación de la herencia a favor de los hijos menores de edad se deba realizar bajo beneficio de inventario, entonces, dicho trámite debe ser en judicial y no en sede notarial?

The new notarial legislation, together with the total reform of the procedural system in civil matters, implements the de-judicialization of some voluntary processes, among them, the acceptance or waiver of inheritance, entrusting its processing to the notary's office. This legal succession institution is complemented with the new provision of the Code of the Families and Family Process, regarding the paternal/maternal authority over the property of minors; limited and supervised in its exercise by the State itself. All these new provisions, have imposed in practice the following question: If the Family Code in its article 51 provides that the acceptance of the inheritance in favor of the minor children must be made under benefit of inventory, then, this procedure must be in court and not in a notary's office?
