La reparación del daño moral por hechos ilícitos en materia civil bajo el enfoque de la Corte Interamericana de Derechos Humanos

Abstract

La presente tesis, está dividida en tres capítulos, que engloban una parte introductoria y el desarrollo teórico, empírico y aplicativo de la investigación. En la introducción, se tienen el diseño de perfil científico investigativo que comprende los antecedentes que motivaron la investigación, la problemática naciente del ámbito inmaterial en que se desenvuelve el daño moral y la manera en que los jueces resuelven este tipo de procesos, la justificación que radica en la conveniencia del estudio del daño moral bajo un enfoque interamericano de derechos humanos como contribución académica que atañe al conocimiento jurídico constitucional, los objetivos específicos y el objetivo general plasmados en el contenido y propuesta, la hipótesis que plantea una herramienta efectiva de reparación y determinación del daño moral, la operacionalización de variables y la metodología utilizada para sustentar este trabajo.

This thesis is divided into three chapters, which include an introductory part and the theoretical, empirical and applicative development of the research. The introduction includes the research scientific profile design comprising the background that motivated the research, the emerging problems of the immaterial field in which moral damage unfolds and how judges resolve this type of proceedings, the justification based on the convenience of studying moral damage under an Inter-American human rights approach as an academic contribution concerning constitutional legal knowledge, the specific and general objectives reflected in the content and proposal, the hypothesis proposing an effective tool for compensation and determination of moral damage, the operationalization of variables and the methodology used to support this work.
