El derecho al medio ambiente desde el enfoque constitucional

Abstract

El trabajo versa en el estudio y análisis técnico desde la perspectiva constitucional sobre la importancia de la protección del medio ambiente como un bien jurídico, lo cual permite una cuidadosa delimitación del ámbito de protección, tal como sostiene el art. 33 de la Constitución Política del Estado, que se encuentra íntimamente ligada con otros preceptos constitucionales, tales como el Art. 342 al art. 347, además del art. 348, el art. 373, art. 380, art. 385, art. 386 y demás artículos que se han invocado en el presente trabajo, que impone al Estado y la población a: conservar, proteger, además de aprovechar los recursos de manera sustentable, cuidando el equilibrio del medio ambiente.The work deals with the study and technical analysis from the constitutional perspective on the importance of the protection of the environment as a juridical good, which allows a careful delimitation of the scope of protection, as stated in art. 33 of the Political Constitution of the State, which is intimately linked to other constitutional precepts, such as Art. 342 to art. 347, in addition to art. 348, art. 373, art. 380, art. 385, art. 386 and other articles that have been invoked in the present work, which impose the State and the population to: conserve, protect, besides taking advantage of the resources in a sustainable way, taking care of the balance of the environment.
