La responsabilidad del notario por autoría material de la escritura pública de contratos de compraventa y anticresis

Abstract

En este trabajo de investigación se realizará una valoración en torno al Notario como autor del documento notarial, las implicaciones y aspectos relevantes en cuanto a asumir este rol. Se considera importante el análisis de las causas que dan origen a la responsabilidad civil del Notario, como autor del documento notarial, donde se evalúa la negligencia en la identificación de otorgantes del documento notarial frente a la suplantación de identidad y adulteración de documentos, errores de forma y fondo en los instrumentos públicos, así como errores materiales y responsabilidad en la Dación de Fe.In this research work, an assessment will be made about the notary as the author of the notarial document, the implications and relevant aspects regarding the assumption of this role. It is considered important the analysis of the causes that give rise to the civil liability of the Notary, as author of the notarial document, where the negligence in the identification of grantors of the notarial document is evaluated against the impersonation and adulteration of documents, errors of form and substance in public instruments, as well as material errors and responsibility in the Notarization.
