El asesoramiento notarial y su importancia

Abstract

La Ley 483 Ley del Notariado Plurinacional, dentro de su redacción, habla del asesoramiento en la función del notario de fe pública, sin embargo ha llamado la atención de quien realiza este estudio el hecho de que existan dos artículos en los que se menciona que el asesoramiento notarial debe darse en forma excepcional y sin embargo exista otro párrafo de la ley que pone al asesoramiento notarial como un deber, tomando en cuenta que se entiende por deber aquello que supone una obligación, entonces surge una pregunta ¿Debe el notario de fe pública asesorar solo cuando este asesoramiento es solicitado o debe el notario de fe pública dar su punto de vista y asesorar en cuanto se percate de la existencia de una injusticia o ilegalidad aunque su asesoramiento no haya sido requerido?Law 483, Law of the Plurinational Notary Public, in its wording, speaks of advice in the function of the notary of public faith, however, the fact that there are two articles in which it is mentioned that notarial advice should be given exceptionally and yet there is another paragraph of the law that puts the notarial advice as a duty, has called the attention of the person conducting this study, Taking into account that a duty is understood as that which implies an obligation, then a question arises: Should the notary public give advice only when this advice is requested or should the notary public give his point of view and give advice as soon as he becomes aware of the existence of an injustice or illegality, even if his advice has not been requested?
