Abstract

El objetivo principal por el cual se realiza esta labor investigativa, es para describir los alcances y aplicaciones del art. 214 respecto al pronunciamiento por equidad, como resolución judicial, según la Ley 439 del nuevo código de procedimiento civil, caracterizando sus ventajas, desventajas, así como también realizando un análisis comparativo con otras legislaciones de países vecinos respecto al tema, realizando al mismo tiempo un estudio de la doctrina respecto a los fallos por equidadThe main objective for which this research work is carried out is to describe the scope and applications of art. 214 with respect to the pronouncement by equity, as a judicial resolution, according to Law 439 of the new code of civil procedure, characterizing its advantages, disadvantages, as well as carrying out a comparative analysis with other legislations of neighboring countries with respect to the subject, carrying out at the same time a study of the doctrine with respect to the judgments by equity.
