Naturaleza jurídica de la cadena de custodia en el " tribunal cuarto de sentencia" de la ciudad de La Paz

Abstract

La cadena de custodia es un procedimiento legal que se utiliza para garantizar que la evidencia recolectada en una investigación se mantenga intacta y segura desde el momento de su obtención hasta su presentación en un juicio. En el presente trabajo de investigación se analizará, la naturaleza jurídica de la cadena de custodia debido a que es de vital importancia para asegurar la validez y la integridad de las pruebas presentadas durante un proceso judicial.<br /> <br /> Analizando los siguientes capítulos podremos comprender que la cadena de custodia no se rige por normas solo por protocolos establecidos por la ley, con el objetivo de prevenir la contaminación, alteración o pérdida de la evidencia, y garantizar que esta sea confiable y veraz. El personal encargado de la cadena de custodia en el IDIF debe cumplir con estrictas medidas de seguridad y control para asegurar que la evidencia se mantenga íntegra y no sufra ninguna manipulación que pueda comprometer su autenticidad<br />The custody chain is a legal procedure that is used to ensure that evidence collected in an investigation remains intact and secure from the moment it is obtained until it is presented in court. In this investigative work, the legal nature of the custody chain will be analyzed, as it is of vital importance to ensure the validity and integrity of the tests presented during a judicial process.<br /> <br /> By analyzing the following chapters we can understand that the chain of custody is not governed by standards only by protocols established by law, with the objective of preventing contamination, alteration or loss of evidence, and guaranteeing that it is reliable and truthful. The personnel in charge of the custody chain at the IDIF must comply with strict security and control measures to ensure that the evidence remains intact and does not suffer anyone from manipulation that could compromise its authenticity
