Resumen/Abstract
El objetivo de la presente tesis (2007) fue encontrar las causas del porqué Bolivia no ha elevado solicitudes de interpretación prejudicial ante el Tribunal de Justicia de la Comunidad Andina (CAN), puesto que hasta la fecha solo se tiene registrada una consulta, el Proceso 87-IP-2002, durante los 19 años de vigencia del Tribunal de Justicia de la Comunidad Andina. Situación que es comparada con otros países miembros que conforman la Comunidad Andina y han realizado la solicitud de interpretación prejudicial con mayor frecuencia. El tipo de estudio utilizado fue el descriptivo y analítico, con una muestra no probabilística o dirigida a jueces en materia penal en la Ciudad de La Paz y a universidades públicas y privadas también de la Ciudad de La Paz; las técnicas utilizadas fueron el cuestionario, análisis de datos (estadística). Comprobándose que Bolivia no ha realizado la consulta de interpretación prejudicial por las siguientes causas: a) desconocimiento de la normativa comunitaria; b) desconocimiento de la forma de plantear la solicitud de interpretación prejudicial. Por otra parte, los jueces desconocen los efectos y las responsabilidades en el proceso integrador comunitario a nivel del Estado boliviano como país miembro.
The objective of this thesis (2007) was to determine why Bolivia has not submitted requests for preliminary rulings to the Court of Justice of the Andean Community (CAN), given that to date only one such request, Case 87-IP-2002, has been registered during the 19 years of the Court of Justice's existence. This situation is compared with other member countries of the Andean Community that have submitted requests for preliminary rulings more frequently. The study employed a descriptive and analytical approach, using a non-probabilistic sample of criminal court judges in the city of La Paz and representatives from public and private universities, also in La Paz. Data collection techniques included questionnaires and statistical analysis. The findings indicate that Bolivia has not submitted requests for preliminary rulings due to the following reasons: a) lack of familiarity with community regulations; and b) lack of knowledge regarding the procedure for submitting such requests. Furthermore, the judges are unaware of the effects and responsibilities in the community integration process at the level of the Bolivian State as a member country.
