Regulación de la figura de la adopción de persona mayor de edad, en el notariado plurinacional

Abstract

La adopción de persona mayor de edad, es una figura jurídica del derecho de familia que se ha incorporado en nuestra legislación a través de la Ley del Notariado Plurinacional, Ley Nº 483 de 25 de enero de 2014, artículo 59 inc. b) que señala a la adopción de persona mayor de edad, como otra escritura pública más. El artículo citado faculta al Notario de Fe Pública, conocer, intervenir, elaborar, redactar el instrumento público de la adopción de persona mayor de edad y autorizar mediante Escritura Pública, confiriéndole Fe a este acto jurídico. En cuanto a los requisitos para la adopción de persona mayor de edad, la normativa en vigencia, la Ley del Notariado y su reglamentación, no establecían nada al respecto, esta fue reglamentada a través del Decreto Supremo 5012 de fecha 6 de septiembre de 2023 y Reglamento de Trámites en la vía voluntaria y otras escrituras aprobado mediante Resolución Administrativa DIRNOPLU 154/2023, de 2 de octubre de 2023. Sin embargo, la normativa actual todavía adolece de algunas observaciones y ambigüedades que serán abordadas en el presente estudio.

The adoption of adults is a legal figure of family law that has been incorporated into our legislation through the Law of the Plurinational Notariat, Law No. 483 of January 25, 2014, article 59 section b) which designates the adoption of adults as another public deed. The cited article empowers the Public Faith Notary to know, intervene, prepare, draft the public instrument of adoption of adults and authorize it through a Public Deed, granting Faith to this legal act. Regarding the requirements for the adoption of adults, the current regulations, the Notariat Law and its regulations did not establish anything in this regard. This was regulated through Supreme Decree 5012 of September 6, 2023 and the Regulations for Proceedings in voluntary jurisdiction and other deeds approved by Administrative Resolution DIRNOPLU 154/2023 of October 2, 2023. However, current regulations still suffer from some observations and ambiguities that will be addressed in this study.
