Fundamentos jurídico – normativos de reforma adjetiva para extender la protección de los actores (directos e indirectos) del proceso penal

Abstract

La tesis que se presenta, abarca el análisis del Programa de Protección a Víctimas, Testigos, Denunciantes y Miembros del Ministerio Público, cuyo fin principal del estudio es efectivizar la solicitud y otorgación de medidas de protección, establecidas en la Ley 458 -Ley de Protección de Denunciantes y Testigos- y de esta manera lograr extender esta protección de los demás actores del proceso penal, ante la ausencia de un mecanismo de protección hacia servidores públicos que coadyuvan en las diferentes etapas del procedimiento penal boliviano; es decir, se trastoca el equilibrio procesal al beneficiar a una parte de la ciudadanía, en desmedro de otro grupo poblacional.The thesis presented covers the analysis of the Protection Program for Victims, Witnesses, Complainants and Members of the Public Prosecutor's Office, whose main purpose is to make effective the request and granting of protection measures established in Law 458 - Law for the Protection of Complainants and Witnesses - and thus extend this protection to other actors in the criminal process, given the absence of a protection mechanism for public servants who collaborate in the different stages of the Bolivian criminal procedure; that is, the procedural balance is disrupted by benefiting one part of the citizenry to the detriment of another population group.
