Resumen/Abstract
La presente investigación tiene como objetivo realizar un análisis jurídico sobre la reducción de la base imponible en bienes inmuebles sin acceso directo a la calle, conocidos como "corazón de manzana", en La Paz, Bolivia. El propósito es identificar los fundamentos legales que respaldan esta reducción y evaluar su aplicación práctica en casos específicos. Para alcanzar este fin, se utilizó una metodología basada en el método dogmático jurídico, deductivo y analítico, con un enfoque descriptivo y propositivo. La recolección de datos se realizó mediante encuestas y entrevistas a una muestra no probabilística de 60 profesionales vinculados al ámbito inmobiliario.
Los resultados obtenidos indican que los profesionales consultados consideran que la falta de acceso directo a la calle afecta significativamente el valor de los bienes inmuebles. Sin embargo, la carga tributaria entre los inmuebles con acceso directo y los que no lo tienen es similar, lo que genera una percepción de injusticia, ya que los inmuebles sin acceso a la calle no reciben un trato equitativo. Asimismo, se observa que no existe una normativa que permita aplicar un descuento sobre el valor de estos inmuebles, ni un sistema claro para cuantificar la cantidad de propiedades sin acceso directo a la calle.
This research aims to conduct a legal analysis regarding the reduction of the taxable base for real estate properties lacking direct street access—known as "block-interior" properties—in La Paz, Bolivia. The objective is to identify the legal grounds supporting this reduction and to evaluate its practical application in specific cases. To achieve this, the study employed a methodology based on legal-dogmatic, deductive, and analytical approaches, with a descriptive and proposal-oriented focus. Data collection was carried out through surveys and interviews with a non-probability sample of 60 professionals linked to the real estate sector. The results indicate that the professionals surveyed believe the lack of direct street access significantly affects the value of real estate properties. However, the tax burden is similar for properties with and without direct access, creating a perception of unfairness, as properties lacking street access do not receive equitable treatment. Furthermore, it is observed that there are no regulations allowing for a valuation discount on such properties, nor is there a clear system for quantifying the number of properties lacking direct street access.
