Efectos del servicio notarial en el ámbito indígena originario campesino dentro el marco de la ley 483 del notariado plurinacional

Abstract

Con la promulgación de la nueva Ley 483 del Notariado se ha generado una incertidumbre en torno a la función del Servicio Notarial Indígena Originario Campesino, surgen varios vacíos tales como: si este remplazará a los Notarios de Fe Pública de 2da. y 3ra. Clase que existían en estos lugares, las autoridades designadas como notarios, serán reconcidas por los comunarios, el Estado o por el Órgano Ejecutivo, y otros aspectos que dejan ambigüedad. Por tal razón, la presente investigación adopta una posición crítica para analizar los aspectos favorables y desfavorables de la implementación del Servicio Notarial en el ámbito indígena Originario Campesino.With the enactment of the new Law 483 of the Notary Public's Office, uncertainty has arisen regarding the function of the Notary Public Service of the Original Indigenous and Campesino Indigenous Notaries, several gaps arise such as: if it will replace the Notaries Public of 2nd and 3rd Class that existed in these places, the authorities designated as notaries, will they be recognized by the community members, the State or by the Executive Branch, and other aspects that leave ambiguity. For this reason, the present investigation adopts a critical position to analyze the favorable and unfavorable aspects of the implementation of the Notary Service in the indigenous native peasant environment.
