Fundamentos, limites y desafíos para la regulación de la responsabilidad extracontractual del Estado Boliviano

Abstract

Continuamente se pone en evidencia a través de los medios de comunicación casos en los cuales se observan daños de diferentes tipos siendo una buena parte de ello ocasionados por el Estado, empero el desconocimiento de que este último no obra bajo un manto de impunidad y que tiene el deber de responder por sus actos hace que dichas situaciones queden sin reparación y solo pasen a ser una noticia más.<br /> El Estado boliviano en su historia no ha mostrado señales claras de aceptar su responsabilidad extracontractual, los tribunales de justicia tampoco han ayudado a esa labor puesto que hasta no hace mucho propugnaba que los daños que pudieran ocasionar los funcionarios debían ser imputados a estos últimos y no así al ente estatal del cual forman parte.It is continually revealed through the media cases in which damages of different types are observed, a good part of it being caused by the State, however, the ignorance that the latter does not act under a cloak of impunity and that it has the duty to answer for their actions makes such situations go unrepaired and just become one more piece of news.<br /> The Bolivian State in its history has not shown clear signs of accepting its non-contractual responsibility, the courts of justice have not helped this work either since until not long ago it advocated that the damages that the officials could cause should be imputed to the latter and not thus to the state entity of which they are a part.
