La teoría del ejercicio operacional del notario, se circunscribe con la vinculación directa del notario con la capacidad de las partes, las prohibiciones, los alcances interpretativos, el control de sus actos finales y su responsabilidad frente a estos, la percepción y conocimiento de lo que da fe y sus consecuencias sobre el orden público
