Síntesis de aplicación del derecho notarial en trámites administrativos civiles, sucesorios y familiares

Abstract

Con la promulgación de la Ley del Notariado Plurinacional y su decreto reglamentario, indudablemente se ha contribuido de manera muy significativa al acceso a la justicia y a la paz social, lo que antes se conocía como proceso sumario de carácter interdicto y/o procesos judiciales hoy con las especificidades de cada caso y el cumplimiento de determinadas formalidades pasan a ser simples trámites administrativos, que de manera pronta y oportuna concluyen con la extensión de las escrituras públicas, mismas que pasaran a registrarse ante instantes pertinentes. En ese sentido, la vía voluntaria notarial no conoce ni ejerce tramites en la vía jurisdiccional, sino más bien da notoriedad a algunos trámites administrativos, precisamente estos trámites son objeto de estudio del presente trabajoWith the enactment of the Plurinational Notary Law and its regulatory decree, has undoubtedly contributed significantly to access to justice and social peace, what was previously known as a summary process of interdict character and / or judicial proceedings today with the specificities of each case and compliance with certain formalities become simple administrative procedures, which promptly and timely conclude with the extension of public deeds, which will be registered before the relevant authorities.
