Resumen/Abstract
La presente investigación aborda el control de convencionalidad en la elaboración de leyes por parte del Órgano Legislativo del Estado Plurinacional de Bolivia, destacando su importancia para garantizar la vigencia plena de los derechos humanos conforme a los tratados internacionales ratificados por el Estado.
De acuerdo con la doctrina y jurisprudencia de la Corte Interamericana de Derechos Humanos, el control de convencionalidad, inicialmente concebido como una atribución exclusiva del Poder Judicial, ha sido ampliado progresivamente a todas las autoridades públicas, incluyendo los órganos legislativos, con el propósito de garantizar la compatibilidad normativa con los estándares internacionales en derechos humanos. Asimismo, se resalta que la Constitución Política del Estado, promulgada en 2009, establece un amplio catálogo de derechos fundamentales y sitúa a los tratados internacionales de derechos humanos como parte del bloque de constitucionalidad, otorgándoles preferencia normativa cuando sean más favorables a los establecidos en la propia Constitución
This research addresses the principle of conventionality control in the drafting of laws by the Legislative Branch of the Plurinational State of Bolivia, highlighting its importance in guaranteeing the full exercise of human rights in accordance with international treaties ratified by the State. According to the doctrine and jurisprudence of the Inter-American Court of Human Rights, conventionality control, initially conceived as an exclusive power of the Judiciary, has been progressively extended to all public authorities, including legislative bodies, in order to guarantee normative compatibility with international human rights standards. Furthermore, it is emphasized that the Political Constitution of the State, promulgated in 2009, establishes a broad catalog of fundamental rights and places international human rights treaties as part of the constitutional framework, granting them normative preference when they are more favorable than those established in the Constitution itself.
