Incorporación de artículos en la ley 483 y el D.S. 2189, para la nulidad de pleno derecho del testimonio con sellos, firma y rúbricas notariales falsificados

Abstract

El presente trabajo de investigación e intervención jurídica proporciona los mecanismos procesales y el sustento legal para evitar que el delito se consuma y que los actos dispositivos queden sin efecto, a este objetivo se propone incorporar un articulado en la Ley 483 que otorgue competencia al Juez Civil con las facultades cautelares y coactivas y legitime expresamente al notario, a la institución notarial y al directamente afectado, estableciendo también los presupuestos procesales en el Decreto Supremo 2189, Reglamentario.The present research and legal intervention work provides the procedural mechanisms and legal support to prevent the crime from being consummated and the dispositive acts from being without effect, to this end it is proposed to incorporate an article in Law 483 that grants jurisdiction to the Civil Judge with precautionary and coercive powers and expressly legitimizes the notary, the notarial institution and the directly affected, also establishing the procedural budgets in the Supreme Decree 2189, Regulatory.
