Resumen : La investigación de este trabajo, se basa en la Constitución Política del Estado Plurinacional de Bolivia de 7 de febrero de 2009 y cómo influencia en el Artículo 173 del Código Penal, tornándose la redacción de este último inconstitucional en su redacción, siendo que la norma suprema, establece derechos, principios y garantías establece un orden jurídico, así en el Artículo 178 establece que “I. La potestad de impartir justicia emana del pueblo boliviano y se sustenta en los principios de independencia, imparcialidad, seguridad jurídica, publicidad, probidad, celeridad, gratuidad, pluralismo jurídico, interculturalidad, equidad, servicio a la sociedad, participación ciudadana, armonía social y respeto a los derechos. II. Constituyen garantías de la independencia judicial: 1. El desempeño de los jueces de acuerdo a la carrera judicial. 2. La autonomía presupuestaria de los órganos judiciales” (Const., 2009, Art. 178).<br /> Los encargados de la administración de justicia, deben cumplir con lo precedentemente establecido, y ante el incumplimiento se tiene el Artículo 173 del Código Penal, pero con la forma como se encuentra redactado reafirma la responsabilidad de los jueces, a tiempo de administrar justicia. Sin considerar que para una correcta administración de justicia y el logro de sus objetivos es preciso considerar una interpretación desde y conforme a la Constitución, además del Bloque de Constitucionalidad y la jurisprudencia; por lo que con la redacción del delito de Prevaricato se limita a la subsunción de la conducta del sujeto activo en cuanto a dictar resoluciones manifiestamente contrarias a la Ley, dejando de lado los distintos tipos de interpretación que son establecidos por el derecho, por consiguiente resulta necesaria que se modifique el tipo penal de Prevaricato.
Descripción : The investigation of this work is based on the Political Constitution of the Plurinational State of Bolivia of February 7, 2009 and how it influences Article 173 of the Criminal Code, making the wording of the latter unconstitutional in its wording, being that the supreme norm , establishes rights, principles and guarantees establishes a legal order, thus in Article 178 it establishes that “I. Without considering that for a correct administration of justice and the achievement of its objectives it is necessary to consider an interpretation from and in accordance with the Constitution, in addition to the Constitutional Block and jurisprudence; Therefore, with the wording of the crime of Prevaricato, it is limited to the subsumption of the conduct of the active subject in terms of issuing resolutions manifestly contrary to the Law, leaving aside the different types of interpretation that are established by law, therefore it is it is necessary to modify the criminal type of Prevaricato.
