| Resumen : | La presente tesis de maestría ha permitido obtener un conocimiento verificable, alcanzado mediante una perspectiva metodológica cualitativa, a través de un enfoque de diagnóstico, descriptivo, y de análisis y síntesis de revisión bibliográfica y entrevistas a funcionarios. Que como podrán apreciar en su lectura, demostrará que el régimen disciplinario del Ministerio Público de Bolivia, vulnera el derecho al debido proceso, por permitir en su normativa la pena anticipada y supuestos de faltas disciplinarias carentes de taxatividad y objetividad (normas en blanco), permitiendo con ello la analogía en su interpretación y aplicación. |
| Descripción : | This master's thesis has allowed to obtain verifiable knowledge, achieved through a qualitative methodological perspective, through a diagnostic, descriptive approach, and analysis and synthesis of literature review and interviews with officials. As you can appreciate in its reading, it will demonstrate that the disciplinary regime of the Public Ministry of Bolivia, violates the right to due process, by allowing in its regulations the anticipated penalty and assumptions of disciplinary offenses lacking taxatividad and objectivity (blank rules), thus allowing analogy in its interpretation and application. |
