Se escogió este tema de investigación debido a que las acciones de garantía son el principal pilar de defensa de los derechos humanos y a que en la actualidad no se puede concebir un orden constitucional u ordenamiento jurídico que no respete los derechos humanos  This monograph deals with the creation of a constitutional court for the Andean community focusing primarily on the precautionary actions of constitutional guarantees and human rights highlighting through this analysis legal figures of important relevance. This research topic was chosen because the guarantee actions are the main pillar of defense of the human rights and that at present it is not possible to conceive a constitutional order or legal order that does not respect human rights<br/>
