La presente investigación versa deque dentro de nuestro ordenamiento jurídico en materia penal (Código Penal Boliviano) el delito de Trata de Personas se encuentra inmerso en el Art. 281 bis del C.P. llegando a vulnerar derechos y garantías constitucionales así como el derecho al debido proceso en su vertiente: principio de legalidad porque deja en la incertidumbre varios componentes objetivos del tipo penal como la determinación objetiva de “matrimonio servil”, “turismo sexual” o “servidumbre costumbrista”, redacción normativa que viola a su vez el principio de “Lex Certa” y que de acuerdo a las encuestas y análisis de las entrevistas a expertos coinciden que el Art. 281 bis del C.P. viola el principio de legalidad, porque no establece de manera clara (Principio de lex certa) la prohibición respecto a las conductas referidas (“servidumbre costumbrista”, “matrimonio servil” o “turismo sexual”) y a efectos de impedir violación al derecho al debido proceso en los juicios penales vinculados a este tipo penal, así como impedir la emisión de Sentencias penales ilegales que dé lugar a que se imponga el subjetivismos del tribunal de juicioLa presente investigación versa deque dentro de nuestro ordenamiento jurídico en materia penal (Código Penal Boliviano) el delito de Trata de Personas se encuentra inmerso en el Art. 281 bis del C.P. llegando a vulnerar derechos y garantías constitucionales así como el derecho al debido proceso en su vertiente: principio de legalidad porque deja en la incertidumbre varios componentes objetivos del tipo penal como la determinación objetiva de “matrimonio servil”, “turismo sexual” o “servidumbre cosumbrista”, redacción normativa que viola a su vez el principio de “Lex Certa” y que de acuerdo a las encuestas y análisis de las entrevistas a expertos coinciden que el Art. 281 bis del C.P. viola el principio de legalidad, porque no establece de manera clara (Principio de lex certa) la prohibición respecto a las conductas referidas (“servidumbre costumbrista”, “matrimonio servil” o “turismo sexual”) y a efectos de impedir violación al derecho al debido proceso en los juicios penales vinculados a este tipo penal, así como impedir la emisión de Sentencias penales ilegales que dé lugar a que se imponga el subjetivismos del tribunal de juicio
The present investigation deals with the fact that within our legal system in penal matters (Bolivian Penal Code) the crime of Human Trafficking is immersed in Art. 281 bis of the Penal Code. It violates constitutional rights and guarantees as well as the right to due process in its aspect: principle of legality because it leaves in uncertainty several objective components of the criminal type such as the objective determination of "servile marriage", "sexual tourism" or "customary servitude", normative wording that in turn violates the principle of "Lex Certa" and that according to the surveys and analysis of the interviews to experts agree that Art. 281 bis of the C.P. violates the principle of legality, because it does not clearly establish (Principle of lex certa) the prohibition regarding the referred conducts ("customary servitude", "servile marriage" or "sexual tourism") and in order to prevent the violation of the right to due process in criminal trials related to this type of crime, The present investigation deals with the fact that within our legal system in criminal matters (Bolivian Penal Code) the crime of trafficking in persons is included in Art. 281 bis of the Penal Code, which violates constitutional rights and guarantees as well as the right to due process in its aspect: principle of legality because it leaves in uncertainty several objective components of the criminal type such as the objective determination of "servile marriage", "sexual tourism" or "customary servitude", normative wording that in turn violates the principle of "Lex Certa" and that according to the surveys and analysis of the interviews to experts agree that Art. 281 bis of the Criminal Code violates the principle of legality, because it does not clearly establish (lex certa principle) the prohibition regarding the referred conducts ("customary servitude", "servile marriage" or "sexual tourism") and in order to prevent violation of the right to due process in criminal trials related to this type of crime, as well as to prevent the issuance of illegal criminal sentences that result in the imposition of the subjectivism of the trial court.
