El artículo 65, que fue aprobado en la Constitución Política del Estado (CPE) en el año 2009, permite la filiación de los niños con la presunción de la paternidad, sin necesidad de la presencia del padre, esto garantiza que no se le niegue al niño el derecho que tiene a la identidad reconocido como un derecho fundamental dentro de la sociedad, gozar de dos apellidos y llegando a hacer un análisis de la aplicabilidad que conlleva este artículo de la Constitución Política del Estado y la vulneración de derechos fundamentales que genera a las partes intervinientes o a uno de los progenitore, el presente trabajo va ligado al padre y sus derechos ligados a la familia, a la imagen, a la honra, por último analizando varios casos también llega a transgredir derechos patrimoniales de los progenitores
