Existe la imperiosa necesidad de priorizar a la autonomía de la voluntad, la libertad de los cónyuges para decidir sobre la situación y estado de familia, para decidir sobre la disolución de la relación matrimonial, de ahí que el cónyuge o ambos, si ya no desean seguir unidos en matrimonio, podrían por el acuerdo voluntario, con la condición de un acuerdo regulador que establezca las obligaciones con respecto a los hijos, así como la división equitativa y de común acuerdo sobre los bienes gananciales, lo que significaría tramitar el divorcio notarial, con importante ahorro de costos procesales y en tiempo breve. Este análisis que se realiza en el presente trabajo, es la causa para plantear el divorcio notarial con hijos y bienes gananciales, modificando los artículos que señala la ley 603 del Código de la Familias y Procedimiento Familiar, así como la Ley 483 y su reglamento con respecto al divorcio notarial. There exists the imperious necessity to prioritize to the autonomy of the will, the freedom of the spouses to decide on the situation and state of family, to decide on the dissolution of the matrimonial relation, hence the spouse or both, if they no longer wish to continue united in marriage, could by voluntary agreement, with the condition of a regulatory agreement that establishes the obligations with respect to the children, as well as the equitable division and of common agreement on the marital property, which would mean to process the notarial divorce, with important savings of procedural costs and in short time. This analysis carried out in the present work, is the reason for proposing the notarial divorce with children and community property, modifying the articles of Law 603 of the Family Code and Family Procedure, as well as Law 483 and its regulations with respect to the notarial divorce.
