El presente trabajo de investigación, presenta un estudio que se propone a analizar si el principio del interés superior del menor en el Estado Plurinacional de Bolivia a través de una interpretación discrecional en la jurisdicción especializada al establecer una responsabilidad penal diferenciada para los menores infractores de 14 a 18 años, consistente en medidas socioeducativas siendo la privación de libertad una excepción a la regla This research presents a study that aims to analyse whether the principle of the best interests of the child in the Plurinational State of Bolivia, through a discretionary interpretation in the specialized jurisdiction, establishes differentiated criminal liability for juvenile offenders between 14 and 18 years of age, consisting of socio-educational measures, with deprivation of liberty as an exception to the rule
