Se llama a los principios de derecho ambiental, RECTORES, en razón que su objetivo fundamental es determinar algunas garantías fundamentales; y aunque tienen el mismo valor positivo que las demás normas, son los factores más importantes que hacen realidad los atributos o propiedades del sistema jurídico por su proyección de aplicabilidad en el complejo mundo del derecho ambiental, por ello su máxima propiedad es la de guiar al intérprete (Juzgadores) en su aplicación.
La presente propuesta de incluirlos en la codificación procesal se basa a en hechos positivos, en tanto que son traídos de instrumentos positivizados en el ordenamiento jurídico internacional, que ha tratado de implantarse a nivel mundial en los diferentes órdenes de la sociedad racional y justo, utilizando para ello elementos orientadores de interpretación y como inagotable fuente de consejo para resolver las cuestiones no previstas por la ley y la costumbre. The principles of environmental law are called RECTORS, because their fundamental objective is to determine some fundamental guarantees; and although they have the same positive value as the other norms, they are the most important factors that make reality the attributes or properties of the legal system due to their projection of applicability in the complex world of environmental law, for this reason their maximum property is to guide the interpreter (Judges) in its application.
The present proposal to include them in the procedural codification is based on positive facts, inasmuch as they are brought from instruments positivized in the international legal order, which has tried to be implanted at world level in the different orders of the rational and just society, using for it guiding elements of interpretation and as inexhaustible source of advice to solve the questions not foreseen by the law and the custom.
