En esta investigación se analiza la naturaleza jurídica del recargo tributario en Ecuador, establecido en el art. 2 de la Ley Reformatoria para la Equidad Tributaria, sancionada por la Asamblea constituyente de Montecristi el 29 de diciembre de 2007, que modifica el art. 90 del Código Orgánico Tributario y, que generó polémica en su aplicación, más allá de la ambigüedad de su contenido qe ya ha propiciado varias interpretaciones. Por ello este estudio pretende definir claramente la naturaleza de esta figura jurídica a partir de un desdoblamiento de la misma en torno a distintos enfoques, que por un lado, van a su asimilación como sanción y, por otro, as su identificación como un instituto financiero This research analyzes the legal nature of the tax surcharge in Ecuador, established in art. 2 of the Reformatory Law for Tax Equity, sanctioned by the constituent Assembly of Montecristi on December 29, 2007, which modifies art. 90 of the Organic Tax Code and, which generated controversy in its application, beyond the ambiguity of its content that has already led to several interpretations.
